Terms and conditions for photo sessions and wedding photography
(Note! New conditions are available from 1 July)
After the session, the photographer will select and edit the photos. Selecting is an editing process where the photographer takes everything into consideration (composition, exposure expression, etc.). After the selection, each photo is edited.
The customer receives a gallery with only these photos where you can download them in high resolution and web resolution.
If the wedding is canceled 12 months before the event, the booking fee will be 100% refunded. If you cancel between: 6 - 4 months, 50% of the booking costs will be charged. If you cancel less than 4 months, the booking fee will be non-refundable. Any travel costs incurred are never refundable.
If the photo shoot is canceled 8 weeks before the event, the booking fee will be 100% refunded. If you cancel between 8 and 4 weeks, 50% of the booking costs will be charged. If you cancel less than 4 weeks, the booking fee will be non-refundable. Any travel costs incurred are never refundable.
YourMoments will never disclose personal information, such as address, date of birth, telephone number, pass it on to third parties unless this has been discussed in advance and has been approved by the customer.
The customer is responsible for storing the photos. It is advisable to make a backup yourself. YourMoments saves the photos for a maximum of 6 months after the photos have been delivered.
After 1 week a sneak preview can be seen, after which the digital photos will be delivered between 2 and 4 weeks. The delivery of a photo album after approval can take up to 6 weeks.
The delivery of the digital photos is between 1 and 2 weeks.
The delivery of a photo album can take up to 2 weeks after approval has been given.
In all cases of damage due to the absence of the photographer due to unforeseen circumstances (for example illness), the liability of the photographer is limited to offering a replacement photographer.
The photographer will, if desired, always try to arrange a replacement comparable photographer within his / her network for the wedding day. However, no rights can be derived from this. The replacement photographer will record the day professionally.
All further processing, such as developing the photos and making the album, will be handled by the booked photographer.
In the event of theft or sudden (unexpected) technical failure of equipment during the execution of the assignment, including, but not limited to, the loss or failure of computers, cameras, memory cards or an accident, the assignment shall, to the extent possible, can be executed and / or edited to the best.
The client cannot declare the photographer liable for such unforeseeable circumstances, nor ask or demand compensation.
In case the date need to be adjusted in due to the corona virus, can be done free of charge. If YourMoments is not available on the new date, YourMoments is limited (if desired) to finding a replacement photographer for the new date and further processing such as editing, photo album, etc. will be handled by YourMoments. In case of cancellation reservation costs minus any costs incurred can be refunded through a gift voucher from YourMoments without a valid date.
After completing the booking form, the photographer will send a payment request. The photographer will reserve the agreed time and date.
A reservation fee of € 400 is requested for weddings. Booking costs and travel costs are non-refundable.
Reservation costs of € 50 are requested within the Netherlands for photo shoots. For bookings abroad, a booking fee of € 50 + travel costs is requested.
The remaining amount must be paid prior to the photo session. It may also be paid in cash on the day of the session.
The promotion of YourMoments is very important. This is why it is important to use the photos of sessions for blogs, competitions and websites. Your privacy is also very important. Therefore, by default, only the first names are used, so it is not possible to find out through Google that they belong to you. If you do not want any first names in the photos, you can indicate this.
If the photos absolutely cannot be used, this is possible for an additional amount of € 200 and YourMoments will not use the photos in any way for promotion.
For wedding photography and lifestyle photography on location, the customer is responsible for choosing a location for photography. YourMoments is happy to think along and can advise on this based on its expertise. If a certain location is desired for the photography, the customer is responsible for all fees such as access, parking, etc. The customer is also responsible for arranging the location and obtaining access. YourMoments can possibly help.
The photos for the free album must be delivered to YourMoments within 2 months of providing the photos, so that the album can be edited. After these 2 months, price differences can be charged to the client. The delivery period may also be delayed after this period due to the current work.
YourMoments creates the album with the photo files you choose yourself. If you like this, YourMoments can make a layout herself. The layout will then be sent for review as pdf file.
Note: The album must be ordered within six months. After this half year the right to an album expires, unless there has been prior consultation.
The favorite photos for the album can easily be sent by telling the photonumber.
The customer receives the first layout of the album within 1 to 2 weeks after the delivery of the desired photos for the album. The customer then has 2 weeks to provide feedback on the photo album.
The album is made by the photographer herself. The customer receives a pdf for approval and the customer can submit corrections or replace photos, delete or move. After approval of the album layout, the album will be ordered. Delivery time is from that moment 3-6 weeks.
If the customer does not respond with feedback on the photo album within 4 weeks and the half year after recording has expired, the album will no longer be taken into production.
The album can be sent by registered mail if desired or picked up (the last option is preferred for security reasons). After YourMoments has received the album, the album is carefully checked to see if everything is satisfactory and then only sent if everything appears to have been printed correctly. Damage after sending from YourMoments to the customer caused by the carrier is not liable on YourMoments. If there is damage and it appears that this was caused by the transport, the sender may be held liable and an attempt can be made to reclaim the amount of the album sent from the carrier (PostNL).
